References to "Elvaris," "we," "us," and "our" in these Terms refer to the business above. References to "you," "Client," and "the Client" refer to the individual or business that purchases or uses our services.
Elvaris provides custom automation workflow design, configuration, and delivery services for real estate professionals. Services are delivered as fixed-price packages ("Starter," "Growth," and "Custom") and optional add-ons as described at getelvaris.com at the time of purchase.
The exact deliverables for each package are set out in the Automation Services Agreement, which is issued to the Client upon payment confirmation and governs the specific terms of each engagement. In the event of any conflict between these Terms of Service and the Automation Services Agreement, the Automation Services Agreement takes precedence for matters related to a specific project.
These Terms of Service govern:
How to purchase. Services are purchased by submitting a Tally intake form and completing payment via Stripe. Payment must be made in full before project work begins. No deposits, payment plans, or deferred billing arrangements exist unless explicitly agreed in writing for Custom packages.
Pricing. All prices are displayed in USD on getelvaris.com. Prices are fixed as described on the package page at the time of purchase and do not change once payment is confirmed, except where a Custom package scope is updated by mutual written agreement.
Payment processing. Payments are processed by Stripe. Elvaris does not store or have access to your card details. By completing payment, you also agree to Stripe's Terms of Service.
Receipts and invoices. A Stripe payment receipt is issued automatically on payment. A formal invoice can be requested by emailing miguel@getelvaris.com.
Taxes. Prices shown on getelvaris.com are exclusive of any applicable taxes. Clients are responsible for determining and paying any taxes applicable in their jurisdiction. Elvaris is a Portugal-based business and is not required to collect US sales tax.
Timeline. Elvaris targets delivery within 5–7 business days for Starter packages and 10–14 business days for Growth packages. These timelines are estimates, not guarantees, and begin only once all required access and information has been provided by the Client.
What you must provide. The Client is responsible for providing in a timely manner: the completed intake form, API keys and CRM credentials, lead source webhook details, and access to a hosted n8n instance. Delays caused by late provision of required materials are the Client's responsibility and do not constitute a delivery failure by Elvaris.
Delivery confirmation. Delivery is confirmed when Elvaris notifies the Client by email that the workflow is live and the walkthrough/training session has been completed. The 30-day support window begins at this point.
Client modifications after delivery. Once the workflow has been handed over, the Client may modify it freely. However, Elvaris is not responsible for fixing issues caused by Client-made changes to the workflow after delivery.
Full refund (within 48 hours of intake review). If, after reviewing the Client's intake form, Elvaris determines it cannot deliver the agreed package — due to an unsupported CRM, an integration that proves technically impossible, or scope that significantly exceeds the package — a full refund will be issued within 48 hours. No work will have begun at this stage.
No refund after delivery. Once the workflow has been delivered and the walkthrough session completed, no refund is available. Ownership of the workflow transfers fully to the Client at this point.
Partial refund. If work has begun but cannot be completed due to reasons within Elvaris's control, a partial refund proportional to work not yet delivered will be offered.
Retainer cancellations. Monthly retainer subscriptions can be cancelled at any time with 14 calendar days' written notice. No refund is issued for the current billing month on mid-cycle cancellations. Retainer billing is managed via Stripe and can be cancelled by emailing miguel@getelvaris.com.
Refund requests must be submitted to miguel@getelvaris.com. Refunds are processed via Stripe and typically appear within 5–10 business days depending on your bank.
You own the workflow. On full delivery and payment, the Client owns the delivered n8n workflow outright and permanently. You may modify, extend, copy, or migrate the workflow without restriction and without ongoing obligation to Elvaris.
Elvaris retains methodology rights. Elvaris retains ownership of the underlying methodologies, scoring logic frameworks, prompt engineering approaches, and architectural patterns used to build your workflow. You receive a working implementation of these — not the methodology documentation itself.
Portfolio use. Elvaris may reference your project in marketing or portfolio materials in fully anonymised form (no company name, no agent names, no identifying detail) unless you explicitly request otherwise in writing.
Website content. All content on getelvaris.com — including text, design, and code — is the intellectual property of Elvaris. You may not reproduce, copy, or redistribute it without written permission.

Elvaris reserves the right to refuse service to anyone who violates these terms or whose use of our services could bring Elvaris into disrepute.
Elvaris integrates third-party platforms including CRMs, lead sources, Twilio, LLM API, and n8n into Client workflows. Your use of these platforms is governed by their own terms of service and privacy policies — not by Elvaris.

The 2-Minute Guarantee applies to the technical response time of the automation system — not to agent response times or downstream lead conversion rates, which are the Client's responsibility.
To the maximum extent permitted by applicable law:
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.
The workflows built by Elvaris automate communication with real estate leads — including SMS messages and emails sent to individuals. The Client is solely responsible for ensuring their use of these workflows complies with all applicable laws and regulations, including but not limited to:
Elvaris is not a legal compliance service and does not provide legal advice. The Client should seek independent legal counsel if uncertain about compliance requirements applicable to their use of the workflow.
These Terms of Service are governed by and construed in accordance with the laws of Portugal. The Portuguese courts shall have exclusive jurisdiction over any dispute arising from these Terms, subject to the following:
Dispute resolution process. Before initiating any formal legal proceedings, both parties agree to attempt to resolve any dispute by good-faith email negotiation. The party raising the dispute must provide written notice to the other party. Both parties then have 30 calendar days to attempt resolution before either may escalate.
Consumer rights. Nothing in these Terms affects any statutory rights you may have under the laws of your country of residence that cannot be waived by contract.
Elvaris may update these Terms of Service at any time. When we do, we will update the "Last updated" date at the top of this page. For material changes affecting existing clients, we will provide at least 14 days' notice by email before changes take effect. Continued use of our services after updated Terms are posted constitutes acceptance.
The Terms in effect at the time of your purchase apply to that specific engagement and cannot be changed retroactively without your written consent.
